EPA’s Water Security Division has developed a process for administering the authorities described in Section 1441 of the Safe Drinking Water Act (SDWA). The SDWA 1441 process allows drinking water and wastewater systems to apply to EPA for a Certification of Need if a water treatment chemical is not “reasonably available.” Specifically, EPA can use these authorities to require Department of Commerce to issue orders to suppliers to prioritize water system customers when there is a shortage of that treatment chemical. The SDWA 1441 authorities cannot be used to address the following: price increases, delayed deliveries due to limited transportation resources, poor customer service, or other contractual disputes between the water system and its supplier.
As of November 16, 2021, EPA has received and processed 27 SDWA 1441 applications for a certification of need. All of the underlying supply issues prompting these applications have been addressed through direct technical assistance from EPA to the water system applicant. EPA was able to work with suppliers, mutual aid networks, and other resources, to secure the needed chemical for the water system applicant. Thus, there was no need to issue a certification of need for any of these applications. EPA continues to collaborate with the chemical sector to implement rapid and effective solutions to supply issues, and prefers this collaborative approach over issuance of orders. However, EPA stands ready to exercise its full authority under SDWA 1441 should the need arise.
EPA has received numerous reports of increasing costs of chemicals and other supplies necessary to operate and maintain water systems. These price increases are due to current market conditions and inflationary pressures, as well as the sharp increase in the cost for transportation logistics.
